1) Acceptance of Terms
By creating an account, uploading documents, requesting admissions or immigration assistance, interacting with our AI, or making payments through the platform, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, do not use the Services.
2) Definitions
- Services: Bidesh App’s web/app platform, AI tools, counseling, document handling, scholarship guidance, payments coordination, and immigration facilitation.
- User or you: Individuals or entities using the Services, including students and parents/guardians.
- Content: Materials you submit (documents, data, essays, forms) and materials we provide (guidance, outputs).
- Immigration facilitation: Non-legal support such as checklists, timeline reminders, and form-filling assistance at your direction; not legal advice.
3) Eligibility & Accounts
- You must be the age of majority under Nepali law (18 years) or use the Services with verifiable consent of a parent/guardian.
- You must provide accurate, complete registration information and promptly update it as changes occur.
- You are responsible for safeguarding credentials and for activity under your account; notify us of suspected unauthorized access.
4) Scope of Services
We provide AI-assisted program discovery, admissions and scholarship guidance, secure document intake and forwarding, payments coordination, travel/onboarding support, and immigration facilitation. Outcomes (admission, scholarships, visas) are determined solely by universities and government authorities.
5) Use of AI & Limitations
- AI outputs are informational, dependent on your inputs and third-party data, and may contain inaccuracies; independently verify critical decisions.
- AI is not a substitute for professional academic, financial, or legal advice.
- You must not use AI outputs to engage in fraud, plagiarism, or misrepresentation.
6) User Obligations & Representations
- You represent that all information you provide is truthful, complete, and lawful to share.
- You agree to comply with deadlines, instructions, and applicable laws and policies (institutional and governmental).
- You will promptly inform us of material changes (academic status, finances, immigration status, refusals).
7) Document Submission, Verification & Authenticity
- You are solely responsible for authenticity of transcripts, test scores, IDs, financial statements, affidavits, and immigration forms.
- You authorize us to transmit documents to institutions, evaluators, or service providers for application processing and verification.
- Suspected forgery or fraud may result in suspension/termination and, where required, reporting to relevant authorities under Nepali law.
8) Fees, Payments, Taxes, Currency & Refunds
- Service fees (e.g., counseling, verification, logistics) are disclosed in-app or in writing; amounts may be shown in NPR or foreign currency equivalents.
- Payments are processed by third-party gateways/banks; we do not store full card details. You are responsible for gateway, bank, FX, and remittance charges.
- Foreign payments and remittances must comply with Nepal Rastra Bank (NRB) directives and applicable foreign exchange rules.
- Taxes (including VAT, if applicable) may be added as required by Nepali law.
- Refunds: Unless a written policy states otherwise, fees are non-refundable once advisory work, document review, or submission support has commenced. University application fees and visa fees paid to third parties are non-refundable.
9) University Admissions Advisory
Recommendations are based on program data and your profile; we do not guarantee admission decisions, seat availability, tuition levels, or timelines set by institutions.
10) Scholarships & Financial Aid Advisory
Scholarship listings and eligibility criteria may change without notice. Final decisions are made by awarding bodies; we do not guarantee outcomes or funding amounts.
11) Immigration & Visa Services — Legal Disclaimer
- Nature of service: We provide non-legal, facilitative support (checklists, timeline reminders, document formatting, form-filling assistance at your direction, interview readiness). We are not a law firm or government authority.
- No guarantees: Visa outcomes are decided solely by immigration authorities (e.g., IRCC, USCIS, UKVI, Australian DHA, Schengen embassies). We do not guarantee approvals, processing times, or outcomes.
- Licensed counsel: If you request, we may coordinate with licensed immigration lawyers/consultants; any legal advice is provided by them, under their engagement terms. We may share necessary data with your explicit direction.
- Sensitive data: You may be asked to provide visa history, prior refusals, financial capacity, and sponsor details. We handle such data under heightened confidentiality; see Section 16 and our Privacy Policy.
12) Government Authorities, Portals & Biometrics
- Where permitted and at your direction, we may assist with organizing portal submissions and appointment scheduling. You remain responsible for the truthfulness of all information submitted.
- We do not collect or store biometrics. Biometrics are obtained and processed by visa centers/embassies according to their rules.
- Government forms and requirements change frequently; always rely on the latest official guidance.
13) Third-Party Services, Links & Integrations
Our Services may link to or integrate third-party sites, tools, payment gateways, document verifiers, or analytics providers. Third-party terms and privacy policies apply; we are not responsible for their actions, content, or policies.
14) Acceptable Use & Prohibited Conduct
- No fraud, forgery, plagiarism, impersonation, or misrepresentation.
- No uploading malware or attempting to bypass security controls.
- No unauthorized scraping, reverse engineering, or commercial exploitation of the platform.
15) Intellectual Property & License to Use
All software, design, logos, and content are owned by Bidesh App or its licensors and protected by IP laws. We grant you a limited, revocable, non-transferable license to use the Services for personal educational purposes. You retain ownership of your uploads; you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, transmit, and display your content solely to operate, provide, and improve the Services and to submit applications you authorize.
16) Privacy & Data Protection
Our data practices (including immigration data handling and AI processing) are described in our Privacy Policy. By using the Services, you consent to those practices.
17) Cross-Border Transfers & Hosting
Data may be processed or stored outside Nepal to reach partner institutions or service providers and for scalable hosting. We implement safeguards appropriate to the nature of data and the recipients’ obligations.
18) Electronic Communications & E-Signatures
You consent to receive communications electronically (email, SMS, in-app). Electronic acknowledgements, clicks, and signatures may constitute valid consent where permitted by Nepali law.
19) Warranties & Disclaimers
- Services are provided “as is” and “as available,” without warranties of any kind.
- We do not warrant uninterrupted or error-free operation or that AI outputs are correct or complete.
- Admissions, scholarships, and visa outcomes are outside our control.
20) Limitation of Liability
To the maximum extent permitted by Nepali law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption. Our aggregate liability for any claim is limited to the greater of (a) fees you paid to us for the Service at issue in the 3 months preceding the claim, or (b) USD 100 (or NPR equivalent).
21) Indemnification
You agree to defend, indemnify, and hold harmless Bidesh App, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your content, your misuse of the Services, your violation of these Terms, or your violation of any law or third-party rights.
22) Suspension & Termination
We may suspend or terminate access immediately for violations of these Terms or law, or where required by an authority. You may stop using the Services at any time. Sections concerning IP, privacy, disclaimers, liability, indemnity, governing law, and dispute resolution survive termination.
23) Compliance with Nepali Law
We operate under Nepali law, including the Companies Act 2063, Electronic Transactions Act 2063, Consumer Protection Act 2075, and applicable Nepal Rastra Bank directives for foreign exchange and remittances. You agree to comply with these and with the destination country’s rules when pursuing international study or visas.
24) Anti-Fraud, Anti-Corruption & Academic Integrity
- No falsified bank statements, admission letters, scores, or identity documents.
- No bribery, kickbacks, or corrupt practices; we may refuse service if suspected.
- We may cooperate with lawful investigations and compliance requests.
25) Force Majeure
We are not liable for delays or failures due to events beyond reasonable control, including natural disasters, strikes, war, civil unrest, government actions, pandemics, power or internet failures, or third-party service disruptions.
26) Governing Law & Jurisdiction
These Terms are governed by the laws of Nepal. Courts located in Pokhara, Gandaki Province, shall have exclusive jurisdiction, subject to Section 27 (Dispute Resolution).
27) Dispute Resolution (Negotiation → Mediation → Courts)
- Parties shall first attempt good-faith negotiation within 15 days of notice.
- If unresolved, either party may propose confidential mediation in Nepal with a mutually agreed mediator.
- If still unresolved, the dispute may be brought exclusively before courts in Pokhara, Nepal.
28) Changes to These Terms
We may amend these Terms due to legal, technical, or business changes. When we do, we will update the “Effective Date” above and, where required, provide additional notice. Continued use after changes constitutes acceptance.
29) Severability, Waiver & Assignment
If any provision is held invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our prior written consent; we may assign to an affiliate or successor.
30) Entire Agreement & Order of Precedence
These Terms, together with the Privacy Policy and any service-specific order, form the entire agreement between you and Bidesh App regarding the Services. In case of conflict, a signed order prevails over these Terms; these Terms prevail over site FAQs or marketing pages.
31) Language & Interpretation
This document is in English and controls in the event of any translation inconsistencies. Headings are for convenience only.
